REGULATORY AGREEMENT FOR MULTIFAMILY HOUSING PROJECTS COINSURED BY HUDRegulatory Agreement • September 27th, 2007
In return for the Secretary's endorsement for mortgage insurance of the Note identified above and to comply with the requirements of the National Housing Act and the regulations and administrative requirements adopted by the Secretary pursuant thereto, the Owner agrees to abide by the provisions of this Agreement. This Agreement will continue so long as the contract of coinsurance remains in force. The Owner agrees that this Agreement shall be binding on its successors, heirs and assigns. Breach of this Agreement may be a basis for denial of additional participation in the Secretary's programs. The Owner's willingness and ability to prevent or cure violations of this Agreement may have a bearing on the Secretary's review of any Owner request for additional participation in the Secretary's programs.
REGULATORY AGREEMENT ADDENDUM FOR SUBSIDIZED PROJECTSRegulatory Agreement • September 21st, 2007
(Include this Addendum in the Regulatory Agreement of any coinsured project which receives Section 236 Interest Reduction Subsidies or which has a Section 8 Housing Assistance Payment Contract, Rent Supplement Contract, Rental Assistance Payment Contract, or any other contract between the Owner and the Secretary, or the Owner and a PHA Contract Administrator, and which commits the Secretary to provide monthly rental assistance payments to the Owner on behalf of eligible tenants. Such contracts are referred to herein as Tenant Assistance Payments Contracts.
