DRH is seeking to subdivide and develop Phase 3 of Craft Farms North (“Phase 3”). A final plat for Phase 3 (the “Phase 3 Plat”) was approved by the Planning Commission of the City (the “Planning Commission”) at its meeting on February 24, 2015; provided, however, that as a condition to such approval, the Planning Commission required, among other things, that (a) DRH construct and install all sidewalks over the common areas and residential lots of Phase 3 (the “Sidewalks”) in accordance with the final, approved subdivision plans for Phase 3 (the “Subdivision Plans”) within two years of the Effective Date, and (b) the Parties enter into this Agreement and DRH deliver the Letter of Credit (hereinafter defined) to the City.
