These eBay Inc. Terms and Conditions of Purchase (the “Terms”), apply only to transactions for which there is no current written agreement between eBay and the supplier listed on the purchase order ("Supplier") and are intended to govern the product purchase or services in question. In instances where no such agreement exists, these Terms, and the Purchase Order (as defined below) to which they are attached, constitute the entire agreement between eBay and Supplier with respect to the products and/or services described herein and supersede all prior oral and written communications relating thereto.
