consigned by the SFA. Pursuant to that assumption, the Vendor agrees to control, secure, and use these commodities in a manner that complies with the United States Department of Agriculture (USDA) commodity regulations in Subpart D of 7 CFR Part 250.50 – 250.54. The Vendor will make the appropriate price adjustment to the SFA, which recognizes the net value of these commodities. The Vendor agrees that the commodities will be used only to produce school meals for the SFA. The Vendor agrees to compensate the SFA for any loss of commodity products through misuse or negligence. The Vendor will maintain records to document that the commodities were used only to benefit the SFA.
