Date Parties Australian Securities and Investments Commission (‘ASIC’) [Insert relevant office address] and [Insert name] as liquidator of [insert name of company] [insert ACN] of [insert address] (the ‘Liquidator’) Recitals The Liquidator has formed the opinion that it is desirable to bring certain matters in relation to the Company and its directors to the attention of ASIC and is intending to lodge a further report with ASIC pursuant to subsection 533(2) of the Corporations Act 2001 (Cth) (‘Corporations Act’). In order to obtain funding to prepare and complete a report, the Liquidator has made an application to ASIC for funding from the Fund. Based on the matters set out by the Liquidator in the Application, ASIC has agreed to provide funding subject to the terms and conditions set out in this Agreement.
