This AGREEMENT is dated and is between Versant Power (the "Company"), a Maine corporation having its office and principal place of business in Bangor, Maine, and on behalf of the customers of the Company identified in Exhibit 1 or Exhibit 2 to this Agreement who comprise the members or subscribers of the (the "Customers"). In situations where the Customer is developing the Facility itself and will be the only entity that will be a Financial Interest Customer for that Facility, the term “Customer” shall be applicable. In situations where the Project Sponsor is developing the Facility and one or more other entities will be a Financial Interest Customer for the Facility, the term “Project Sponsor” shall be applicable.
