agreed to be bound by the Industry Wide Agreement (“IWA”), a collective bargaining agreement between the Union and the Hotel Association of New York City, Inc. See Bokerman Decl ¶ 11; see generally IWA, ECF No. 7-4. Urban Commons retained Highgate Hotels, LP (“Highgate”) to operate the Hotel. See Bokerman Decl. ¶ 11; SDNA ¶ A. BPC Lender, LLC, (the “Lender”) financed the purchase of the Hotel. See generally SDNA; Mortgage, ECF No. 7-6. Urban Commons executed a mortgage agreement and a subordination, assignment, non-disclosure, and attornment agreement (together, the “Mortgage Agreements”) in connection with the loan.
