that such agreement is not in con- formity with the regulations as the re- sult of a misunderstanding of the pro- gram procedures by a signatory to the agreement, a modification of the agree- ment may be made by mutual agree- ment. If persons who are currently eli- gible to execute the corrected agree- ment are unwilling to do so, the agree- ment shall be terminated and all pay- ments paid or payable under the agree- ment shall be forfeited or refunded, ex- cept as may be allowed by the Deputy Administrator in accordance with the provisions of § 752.25.
