These terms and conditions apply to all Members (as defined below) and Merchants (as defined below) of the proprietary transaction processing services system offered by Relay Payments Inc. (hereinafter, the “Relay System”). Your use of Relay Products and the Relay System as a Member or Merchant for any purpose constitutes Your agreement to the terms and conditions set forth herein, as subsequently amended or modified at Relay’s sole discretion, unless otherwise agreed to in writing between You and Relay. These terms and conditions are also hereby incorporated into any Member or Merchant Master Services Agreement and Order form (hereinafter, an “MSA”) executed by You and Relay, setting forth Your Relay subscription services and Relay Products. To the extent You are a Member utilizing the Relay mobile app, You hereby agree to be bound by these Terms and Conditions as well.
