WHEREAS by Order (the “Appointment Order”) dated June 20, 2019, The Fuller Landau Group Inc. was appointed by the Honourable Justice Hainey of the Ontario Superior Court of Justice (Commercial List) (the “Court”) to be the receiver of all of the assets, undertakings, and properties of the Debtor (as hereinafter defined), including the real property municipally known as 1820 Rogers Road (formerly 2 Lansdowne Place), Perth, Ontario, which consists of a partially completed residential 3-story, 26-unit condominium complex with underground parking, which has not to date been registered under the Ontario Condominium Act, 1998, together with certain residual land (collectively, the “Assets”), pursuant to Section 243 of the Bankruptcy and Insolvency Act (Canada) (the “BIA”) and Section 101 of the Court of Justice Act (Ontario);
