This Electric Energy Services and Sales Agreement ("Agreement"), is entered into as of this ____ day of April, 2001 (the "Effective Date"), by and betweenamong ENRON ENERGY SERVICES, INC., a Delaware corporation ("EESI"), and SYSCO CORPORATION, a Delaware corporation ("Sysco Corporation"), and the parties listed on Schedule A (Sysco Corporation and the parties ("Customer"). EESI and Customerlisted on Schedule A being collectively referred to as the “Sysco Parties”). EESI and the Sysco Parties are also referred to herein individually as a "Party" and collectively as the "Parties." Capitalized terms used herein but not defined where they appear are defined on Exhibit A.
