WHEREAS, the Kansas Department of Transportation (“KDOT”), acting on behalf of the Federal Highway Administration as the Responsible Federal Agency for the implementation of Section 106 of the National Historic Preservation Act (“NHPA”) (54 U.S.C. § 306108) and 36 C.F.R. Part 800 et seq., has determined that the proposed bridge replacement project, Project 18 C-5289-01 (“Project”) is an undertaking, as defined by 36 C.F.R. § 800.16(y), and that the Project will have an adverse effect on the properties that are listed or potentially eligible for listing in the National Register of Historic Places, located in Cowley County, Kansas; and
