Representative present. Where the employee elects not to have a Union Representative present or a Representative is not available, the absence of a Union Representative not the Employer's right to discipline, suspend or dismiss and shall not be used as a reason to request an arbitrator to amend or overturn the action taken. The Employer agrees to make a reasonable effort to obtain a Union Representative where an Employee elects to have such representation.
