Payments pursuant to this contract are to be made only from monies made available to the Oklahoma Department of Commerce (ODOC) for weatherization activities by the source identified in Part I. Notwithstanding any other provisions, payments to the Subgrantee Recipient by ODOC are subject to the availability of such funds to ODOC, as determined by Federal and/or State action and/or law. ODOC may take any action necessary in accordance with such determination.
