THIS SUPPLEMENTAL AGREEMENT (“Agreement”) is made and entered into as of May , 2010, by and among FOURTH STREET APARTMENTS, L.P., a California limited partnership (“Borrower”), CALIFORNIA COMMUNITY REINVESTMENT CORPORATION, a California nonprofit public benefit corporation (“CCRC”), and the CITY OF SAN JOSE, a municipal corporation and chartered city, duly organized and existing under the Constitution and laws of the State of California (the “Issuer”).
