The Plaintiffs who are acting as the Class Representatives on behalf of themselves and all other Settlement Class Members of the Settlement Class set forth herein, expressly excluding any and all Excluded Persons, as defined herein, and Uponor, Inc., Wirsbo Company and Uponor Wirsbo, Inc. (hereinafter collectively "Uponor"), stipulate and agree, pursuant to the terms and conditions set forth in this Class Action Settlement Agreement and Release ("Agreement") to settle, dismiss, and compromise fully and finally the Legal Claims asserted against Uponor and the Materially Contributing Entities as defined herein and their related companies, for any and all issues allegedly related to the dezincification of the Uponor Yellow Brass Fittings, including workmanship related to dezincification (as referenced further herein), installed in Settlement Class Members’ Residential Unit(s), Non-Residential Property, and/or Common Areas built on or after January 1, 2002.
