This Development and Consent Agreement (“Agreement”) is entered into by and between the City of Elgin, Texas, a home-rule city located in Bastrop County, Texas, with extraterritorial jurisdiction extending into Travis County, Texas (the “City”), and BTR Development, Inc., a Texas corporation (“Developer”). Bastrop Trinity Investors, LLC, a Texas limited liability company (“Owner”), the current fee simple owner of the Property (defined below), joins in this Agreement for the purpose of evidencing its consent to this Agreement. Elgin Municipal Utility District No. 1 and Elgin Municipal Utility District No. 2 (each, a “District” and, collectively, the “Districts”), each of which is a municipal utility district that has been created, will join this Agreement as set forth below and after such joinder shall become a party to this Agreement.
