WHEREAS, Both Parties desire to locate and maintain an Automated Teller Machine ("ATM"), at the Facilities owned or leased by Customer listed on Exhibit A attached hereto and made part hereof, (collectively, the "Facilities"). For purposes of this Agreement, ATM shall include all devices functionally equivalent to an ATM whether referred to by their manufacturers as customer bank communication terminal, remote service unit or otherwise; however, ATM shall not include any machines which sell merchandise or perform transactions of a nature other than financial transactions; and
