This Stipulation and Agreement of Settlement is submitted pursuant to CPLR 908 in furtherance of the settlement of this Action.1 Subject to preliminary and final approval of the Court, the Settlement is entered into by Plaintiffs and Class Representatives Paula Gerard, Sherri Lydell, Lisa Quitoni, and Laura Zingmond on behalf of themselves and all others similarly situated (“Plaintiffs”), and Defendant Clermont York Associates LLC (“Defendant”), by and through their respective attorneys.
