No element of this Settlement Agreement shall be deemed precedential as to the Commission or any of the Parties, either in the context of this San Diego Gas & Electric Company (SDG&E) 2009 Rate Design Window (“RDW”) -- Application 08-11-014, proceeding or in any future proceeding, and no Party shall use the contents of this Settlement, or any documents, discussions or other communications related to this Settlement, against any other Party in future Commission proceedings.
