This Settlement Agreement and Release ("Agreement") is entered into by and among plaintiff Elisalynn Clark ("Named Plaintiff') and all those on whose behalf she is prosecuting this action (each of them a "Plaintiff' and all of them "Plaintiffs"), on the one hand, and defendant Hills Bank and Trust Company ("Defendant"), on the other hand, as of the date executed below. All references in this Agreement to a "Party" or the "Parties" shall refer to a party or the parties to this Agreement.
