The parties (“Parties”) to this Settlement Agreement (“Agreement”) are the United States of America (“United States”) and Fairfax Nursing Center, Inc. (“FNC”), a skilled nursing facility located in Fairfax County, Virginia. This matter was initiated by a complaint filed with the United States against FNC, alleging violations of title III of the Americans with Disabilities Act of 1990, as amended (the “ADA”), 42 U.S.C. §§ 12181-12189, and its implementing regulation, 28 C.F.R. Part 36. Specifically, Complainant B.D. and Complainant D.D. (the “Complainants”), who are both deaf, alleged that FNC personnel failed to provide sign language interpretive services when necessary to ensure effective communication with the Complainants. V.P., an 83 year-old, suffered a fractured leg and stayed at FNC from May 20 through July 14, 2014, for physical rehabilitation of her fractured leg.
