Whereas the DESIGN-BUILD FIRM accepts the relationship established between it and the OWNER by this Agreement. It covenants with the OWNER to demonstrate high performance in the industry to its best skill and judgment and to cooperate in furthering the interests of the OWNER. It agrees to furnish efficient business administration and superintendence and use its best efforts to complete the project in the best and soundest way and in the most expeditious and economical manner consistent with the best interest of the OWNER and with the terms and conditions of this Agreement.
