Distribution System through the Set Top Box (“STB”) in an encrypted form, in the Territory for distribution to Subscribers (“Rights Granted”). 3.2 The Rights Granted herein are only for Ordinary Subscriber and not for any Commercial Subscriber. The DTHO agrees and confirms that STAR shall be entitled to charge separately to/for retransmission of Channels to Commercial Subscribers which shall be subject to the terms and conditions set out in a separate agreement to be executed between the parties. The DTHO acknowledges and agrees that any violation of this clause by the DTHO shall be construed as material breach of this Agreement 3.3 The Rights Granted to the DTHO in terms of Clause 3.1 are limited to Subscribers having an addressable STB, in relation to whom the DTHO compulsorily maintains the complete detailed data and transaction records in its SMS.
