This Agreement is executed on January 1, 2012, by and between Curian Variable Series Trust (the “Trust”) and Jackson National Life Distributors LLC (“JNLD”) and, as provided in Section 11 below, shall become effective on the effective date of the registration statement of the Trust on Form N-1A (the “Registration Statement”), as amended from time to time under the Investment Company Act of 1940, as amended (the “1940 Act”).
