PERFORMANCE AGREEMENT (this “Agreement”) is made and entered this day of October 2015, by and among the COUNTY BOARD OF ARLINGTON COUNTY, VIRGINIA (the “County”), a body corporate and politic of the Commonwealth of Virginia (the “Commonwealth”), LIDL US, LLC, a Delaware limited liability company authorized to transact business in the Commonwealth and its affiliates (collectively, “Lidl”), and the INDUSTRIAL DEVELOPMENT AUTHORITY OF ARLINGTON COUNTY, a political subdivision of the Commonwealth (the “IDA”). Individually, the County, Lidl, and the IDA may each be referred to hereinafter as the “Party,” or collectively as the “Parties.”
