On September 30, 2008, SPP filed amendments to its Bylaws, Tariff, and to the Membership Agreements executed by Nebraska Public Power District (“NPPD”), Omaha Public Power District (“OPPD”), and Lincoln Electric System (“LES”) (collectively “Nebraska Entities”).2 The purpose of the September 30 Filing was to facilitate the Nebraska Entities becoming members of SPP without compromising their unique status as non-Commission jurisdictional state and municipal public power agencies, violating their state and local legal obligations, or jeopardizing their tax-exempt status.
