Contract Type FiledMarch 15th, 2012 Company IndustryThis Amended and Restated Employment Agreement (the "Agreement") dated as of December 19, 2011 and effective as of November 21, 2011 (the "Effective Date"), is made by and between Bradley J. Fisher (the "Executive") and Hawaiian Telcom Communications, Inc. and any of its subsidiaries and affiliates as may employ Executive from time to time (collectively, and together with any successor thereto, the "Company") and as authorized to do so by United States Citizenship and Immigration Services, and supersedes in its entirety that certain Amended and Restated Employment Agreement between the parties dated as of November 17, 2011. Notwithstanding anything herein to the contrary, this Agreement shall be void and of no force and effect if within 20 days of the Effective Date the Company is not, acting reasonably and in good faith, satisfied with the results of a background check on the Executive.
