These BRAY COMMERCIAL DIVISION (BCD) PREFERRED PURCHASER PLAN TERMS (this “Agreement”) is effective as of the date first noted above (upon entry into the BCD Plan (as defined below), the “Effective Date”) by and between the Bray Commercial Division, a division of Bray Sales, Inc. (“BCD”), and the contractor agreeing to become a participant (“BPP”) in BCD’s Preferred Purchaser Plan (including, without limitation, as amended, supplemented and otherwise modified by BCD from time to time, the “BCD Plan”). BCD and BPP are each a “Party” and collectively referred to as the “Parties”.
