On the 11th of January, 2011 the Vice President of Marine Mammal Operations requested that the appellant produce a Behavior Occurrence Log which was required for a legal matter regarding a guest injury. The appellant advised that he could not find the log and was given a warning. A few days later he produced the log claiming that it had been there all the while and simply had been misplaced in another file. The appellant was suspended and later discharged when it was determined that he had misrepresented the facts surrounding when the log was created and such behavior amounted to gross misconduct. The appellant brought a claim for damages for both wrongful and unfair dismissal of his contract of employment in the lower court.
