This OverPower Marketing Data Processing Agreement and its Annexes A, B, and C (“DPA”) is between OverPower Marketing LLC (“OverPower Marketing”) and the party executing this agreement as Customer (“Customer”). This DPA reflects the parties’ agreement with respect to the Processing of Personal Data by OverPower Marketing on behalf of Customer in connection with the Service under the contemporaneously-executed Terms of Service agreement between the parties (“Agreement”).
