These terms and conditions, together with the application, constitute a contract entered into among CI Investments Inc. (“CI”) (the “Promoter”), as Promoter of the Plan, Canadian Western Trust Company, as Trustee of the Plan and either one individual or an individual and his or her spouse or common-law partner (the “Subscriber”), or a Public Primary Caregiver, under which the Promoter agrees to pay or to cause to be paid Educational Assistance Payments to or for one or more Beneficiaries. Canadian Western Trust Company, a trust company amalgamated under the laws of Canada to carry on in Canada the business of offering to the public its services as a trustee (the “Trustee”) hereby declares that it agrees to act as Trustee for the CI Education Savings Plan.
