This Data Processing Agreement (“DPA”) is hereby incorporated into and is governed by the Terms and Conditions of Sales and Service Projects or the Terms and Conditions of SOW Services between Seller and Customer, as applicable (the “Agreement”) and applies to the extent that Seller processes any Personal Da ta (as defined herein) on behalf of Customer in the provision of Services thereunder. The purpose of this DPA is to set out the rights and obligations of the Parties in respect of the Personal Da ta processed by Seller in its capacity as a processor or service provider under the Agreement.
