This Exclusive Marketing Agency Terms of Service (this “Terms”) is made and entered into by and between EXCLUSIVE MARKETING AGENCY, LLC, a California limited liability company (“EMA”), and the entity or person agreeing to these terms (“Client”). These Terms is effective as of the date Client clicks to accept these Terms (the “Effective Date”). Any individual accepting these Terms on behalf of Client, hereby represents and warrants that: (i) such person has full legal authority to bind Client to these Terms; (ii) such person has read and understands these Terms; and (iii) such person agrees, on behalf of Client, to the terms of these Terms. Pursuant to the applicable service order form completed by Client (the “Service Order”), which is hereby incorporated by reference, Client desires to obtain from EMA those services requested on the Service Order (the “Services”), subject to and in accordance with the terms and conditions of these Terms.
