DeKalb Regional is a state funded crisis mental health treatment provider located at 450 Winn Way, Decatur, Georgia that provides mental health services for people living in the metropolitan Atlanta area. DeKalb Regional operates a 24-hour, seven day a week emergency crisis mental health treatment center. This matter was initiated by a complaint filed with the United States against DeKalb Regional, alleging violations of Title II of the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12131-12134, and the Department of Justice’s regulation implementing Title II, 28 C.F.R. Part 35. Specifically, the Complainant alleges that DeKalb Regional failed to provide sign language interpretive services during her 13 day admission at the facility when necessary to ensure effective communication.
