THIS DEED OF CONSERVATION EASEMENT (“Conservation Easement”) is given this _____ day of _______________, 20__, by EIP Florida, LLC, having an address of 2002 Clipper Park Road, Suite 201, Baltimore, MD 212122 ("Grantor") to the Southwest Florida Water Management District, having a mailing address of 7601 Highway 301 North, Tampa, Florida 33637-6759 ("Grantee"), with third party enforcement rights to the U.S. Army Corps of Engineers (“Third Party Beneficiary”). As used herein, the term "Grantor" shall include any and all heirs, successors, or assigns of the Grantor, and all subsequent owners of the Property (as hereinafter defined); the term "Grantee" shall include any successor or assignee of Grantee; and the term “Third Party Beneficiary” shall include any successor or assignee of the Third Party Beneficiary.
