This document serves as an agreement between the owners of Elk Point Resort, Jake’s Resort and Supper Club, Pioneer Grill and Saloon (hereafter referred to as the business owners) and the Town of Tainter concerning music played at these businesses. In a meeting open to the public, in 2006, and again in 2008, including meetings before the Town board and meetings before the Town land use planning commission, there was extensive discussion regarding the noise associated with music played at these businesses. In May 2006, the business owners, and the Town of Tainter entered into an agreement wherein DJ and/or live band music would end at 11:00 PM on Sunday, Monday, Tuesday, Wednesday, and Thursday nights unless that night is a night before a legal federal holiday. Legal bar-time remained the time for ending DJ and/or live band music on all other days.
