THIS LEASE ("Lease" or "Agreement") is made and entered into this 1st day of January, 2011, between THE CITY OF MOUNTLAKE TERRACE, a municipal corporation of the State of Washington, as lessor (hereinafter "City or Lessor"), and Hardy Golf, LLC, a Washington corporation, as lessee (hereinafter "Hardy or Lessee"), and collectively known as “Parties” with respect to real property situated within the City limits of Mountlake Terrace in Snohomish County, Washington, as described in Exhibit "A" attached, together with the buildings (including the "Clubhouse" and "Maintenance Building") and other improvements now existing thereon and to be constructed thereon (the "Premises") and the Golf Course and Clubhouse machinery and equipment described in Exhibit "B" attached and all replacements thereof (the "Equipment") and the furnishings described in Exhibit "C" attached (the "Furnishings").
