WHEREAS, the County is authorized and required to regulate and control the disposition of storm and surface waters within the MS4, as set forth in the Summit County Stormwater Ordinance, as amended (“381-A”), adopted pursuant to the Utah Water Quality Act, as set forth in Utah Code Ann. §§ 19-5-101, et seq., as amended (“Act”); and
