This Class Action Settlement Agreement (“Agreement” or “Settlement Agreement”) is entered into by and between First Financial Credit Union (“FFCU”), on the one hand, and Brenda Briscoe and Roberta Keast1 (“Plaintiffs” or “Class Representatives”), both individually and on behalf of the Settlement Class, on the other hand, in the case of Briscoe v. First Financial Credit Union, Case No. D-202-CV-2022-02974, currently pending in the Second Judicial District of the County of Bernalillo, New Mexico (the “Litigation”). FFCU and Plaintiffs are each referred to as a “Party” and are collectively referred to herein as the “Parties.”
