This Development and Consent Agreement (“Agreement”) is entered into by and between the City of Elgin, Texas, a home-rule city located in Bastrop County, Texas, with extraterritorial jurisdiction extending into Travis County, Texas (the “City”), and Clayton Properties Group, Inc., a Tennessee corporation doing business in Texas as Brohn Homes (the “Developer”). The Altessa Municipal Utility District (the “District”), which is a municipal utility district to be created, will join this Agreement as set forth below and after such joinder shall become a party to this Agreement.
