FIRST AMENDMENT TO JOINT STIPULATION OF CLASS ACTION AND PAGA SETTLEMENT AND RELEASE

This First Amendment to Joint Stipulation of Class Action and PAGA Settlement and Release (this “First Amendment”) between Plaintiffs Rosina DiStefano, Denario Dush, and Jonathan Brims (together, “Plaintiffs”) and iPayment, Inc. (“iPayment”), Leaders Merchant Services, LLC (“Leaders”) and Paysafe Partners, L.P. (“Paysafe”) (collectively, “Defendants”), amends that certain Joint Stipulation of Class Action and PAGA Settlement and Release filed with the Los Angeles Superior Court (Case No. JCCP 5009) on December 12, 2019 (the “Settlement Agreement”). Capitalized terms not otherwise defined in this First Amendment shall have the meaning set forth in the Settlement Agreement, and references to Paragraph numbers shall refer to Paragraph numbers in the Settlement Agreement.
