This Data Protection Addendum ("DPA") forms part of the Customer Agreement ("Agreement") (or other such titled written or electronic agreement addressing the same subject matter) between Shape Security and Customer for the purchasing of enterprise defense services and/or additional protection services from Shape Security, Inc. (identified collectively either as the “Shape Security”, “Service”, “Vendor”, or otherwise in the applicable agreement, and hereinafter defined as the “Service”), wherein such agreement is hereinafter defined as the “Agreement,” and whereby this DPA reflects the parties’ agreement with regard to the Processing of Personal Data. Customer enters into this DPA on behalf of itself and, to the extent required under applicable Data Protection Laws and Regulations, in the name and on behalf of its Authorized Affiliates, if and to the extent Shape Security processes Personal Data for which such Authorized Affiliates qualify as the Controller.
