(“Company”), and Nissan North America, Inc., a Delaware corporation (“Nissan”) (each, a “Party” and collectively, the “Parties”). For purposes of this Agreement, Contractor acknowledges and agrees that all rights granted to Nissan under this Agreement shall also be deemed to include all entities directly or indirectly controlled by, controlling, or under common control with Nissan or its affiliates (“Affiliates”). As used in this Agreement, all references to “include” or “including” mean inclusive by way of example, and do not mean restrictive by way of limitation.
