(together with its affiliates, “Covestor”), a company formed under the laws of the United Kingdom and registered under the United States Investment Advisers Act of 1940, as amended (the “Act”), hereby confirms its agreement with you regarding our right to acquire and use certain data generated by you, as well as the other matters set forth herein, on the terms and conditions set out herein and the appendices hereto and made a part hereof (collectively, this “Agreement”).
