THIS EIGHTH AMENDMENT (“Amendment”) is made as of October 7, 2021 (“Amendment Effective Date”) by and between Equitable Financial Life Insurance Company of America (formerly known as MONY Life Insurance Company of America) (the “Company”), on its own behalf and on behalf of each segregated asset account of the Company set forth on Schedule A hereto as may be amended from time to time; PIMCO Variable Insurance Trust (the “Fund”), and PIMCO Investments LLC (the “Underwater”). The Company, Fund and Underwriter are collectively referred to as “Parties” and individually as a “Party”.
