This Tax Abatement Agreement (“Agreement”) is made and entered into by and between Western Texas College (“WTC"), acting by and through its duly elected officers, and CROSS TRAILS ENERGY STORAGE PROJECT, LLC a Delaware Limited Liability Company (“CROSS TRAILS” or “Owner”) as owner of the Eligible Property (as hereinafter defined) to be located on the tract of land within the WTC/Camp Springs Road #1 Reinvestment Zone, shown on Exhibit A to this Agreement.
