This Program Management Agreement (thi s “Agreement”) is made on the date specified on Appendix I (the “ Effective Date") by and between CONSTRUCTION MANAGEMENT AMERICA LLC., a Phoenix, Arizona liability company, with its principal place of business at 7950 E. Redfield Road, Suite #260, Scottsdale, AZ 85260 ( “Program Manager”) and the party ( DR BG) listed on Appendix I to this Agreement as the Company ("Company'').
