The terms and conditions that may be offered by Hawaiian Electric Company, Inc. in an energy storage power purchase agreement may be modified to reflect factors such as different storage technologies, project specifics, changes in applicable rules, guidance from the Public Utilities Commission in proceedings concerning the approval or negotiation of such energy storage power purchase agreements, results of an interconnection requirements study and other negotiated terms and conditions. This document also assumes that the proposed facility will be a battery energy storage system. If a proposal containing technology other than a battery for the energy storage system is selected for the RFP’s final award group, replacement provisions accounting for such differing technology will need
