Riley, as Personal Representative of the Estate of Sharyn An Riley, Deceased, v J & J Farmer Leasing, Inc., Farmer Brothers Trucking Co. and Calvin Orange Rickard, Jr., Washtenaw Circuit Court Case No. 95-1816-NI, failed to settle and proceeded to trial. Defendant was the insurer of the defendants in the underlying case and provided a defense. The jury awarded in excess of $3,000,000 against J & J Farmer Leasing, Inc., Farmer Brothers Trucking Co., and Calvin Orange Rickard, Jr. (farmers). Defendant subsequently paid its policy limit of $750,000, leaving plaintiffs J & J Farmer Leasing, Inc., Farmer Brothers Trucking Co. and Calvin Orange Rickard, Jr., liable for the balance of the judgment. Plaintiff James W. Riley joined with the other plaintiffs, his judgment debtors, and filed the instant suit alleging bad-faith refusal to settle the wrongful-death case.
